Terms of sale and provision of services on the website
I. General provisions
1. These terms of sale define the rules of sale of goods and provision of services via the website https://044garden.com

II. Definitions
1. Seller/Service Provider – 044 GARDEN Sp. z o.o. providing services or selling goods via the website.
2. Customer – a natural person, legal person or organizational unit making a purchase or using services.
3. Goods – products offered on the website.
4. Service – services provided electronically via the website.
III. Principles of making purchases
1. Orders can be placed 24 hours a day via the website.
2. The Customer is obliged to provide true and current data in the order form.
3. The sales agreement is concluded when the Customer receives an order confirmation via e-mail.
4. The prices of goods/services given on the website are gross prices (include VAT) and are expressed in EUR, USD, PLN.
5. Delivery costs are added to the order in accordance with the information provided on the website and depend on the selected delivery method.
IV. Payments
1. Payments for orders can be made via:
• Bank transfer
• Payment cards (Visa, MasterCard)
• Online payment systems (e.g. PayPal, Przelewy24)
2. The customer is obliged to pay for the order within 7 days of placing the order.
V. Order fulfillment and delivery
1. The order fulfillment time is 3-5 business days, counting from the date of payment posting.
2. The ordered goods are delivered via DHL or other selected carriers.
3. In the event of delays in delivery, the Seller undertakes to immediately inform the Customer and propose an alternative delivery date.
VI. Right to withdraw from the contract
1. The Customer has the right to withdraw from the contract within 14 days of receiving the goods without giving a reason, in accordance with the Consumer Rights Act.
2. To exercise the right to withdraw from the contract, the Customer must inform the Seller in writing (e-mail or withdrawal form).
3. The return of goods should take place no later than within 14 days of submitting the declaration of withdrawal. The cost of return is borne by the Customer.
VII. Complaints
1. The Customer has the right to file a complaint in the event of non-compliance of the goods with the contract or a defect in the purchased product.
2. Complaints can be submitted in writing to the e-mail address: 044garden@gmail.com or by post to the company's registered office address.
3. The complaint will be considered within 14 working days of its receipt, and the Customer will be informed of the outcome of the complaint procedure.
VIII. Personal data protection
1. The administrator of the Customer's personal data is 044 GARDEN Sp. z o.o..
2. Personal data are processed for the purpose of fulfilling orders and providing services electronically in accordance with the Privacy Policy.
3. The Customer has the right to access their data, correct it and request its deletion.
IX. Final provisions
1. In matters not regulated by these regulations, the provisions of Polish law shall apply, including the Civil Code and the Consumer Rights Act.
2. The Seller reserves the right to change the regulations, but the changes will not affect orders placed before their introduction.
3. These regulations shall apply from 24.09.2024.
